Archive: Are chats with Claude attorney-client privileged?
This article describes an earlier version of PiBye, released as Sidebar. PiBye now uses Import → Review → Use with AI → Restore, with explicit file handoff and no automatic Claude connection. In United States v. Heppner (S.D.N.Y., February 2026), a court held that a defendant’s consumer Claude chats were not protected by attorney-client privilege or work product. Putting a client file into Claude is a third-party disclosure problem. Redaction does not turn that chat into a privileged communication.

What the 2026 ruling actually said
Bradley Heppner used consumer Claude after engaging counsel. He put information he had learned from his lawyers into the tool, generated documents, and later shared those documents with counsel. When the government seized them, the defense claimed privilege and work product. Judge Jed Rakoff rejected both.
The opinion, as summarized by law-firm write-ups, turned on familiar elements: Claude is not a lawyer; the consumer privacy policy undercut a reasonable expectation of confidentiality; the purpose was not obtaining legal advice from counsel. Sharing what counsel had said with a third-party model could waive privilege over that content.
Enterprise tools with contractual confidentiality, used at counsel’s direction, were distinguished. Consumer Claude was not.
Where redaction still matters
Privilege is about communications. Redaction is about identifiers in a file. They are not the same lever.
If a practice has already decided that Claude Desktop may read a matter folder, sending the original still hands Anthropic (or the configured endpoint) every name and number on the page. Sending a Vault of approved, tokenized copies hands it the story without those values. That is a data-minimization step. It is not a privilege argument.

What to do instead of hoping the chat is privileged
Ask the firm’s counsel whether consumer Claude is allowed on matter facts at all. If it is not, do not attach the folder.
If a redacted Vault is allowed, point Claude Desktop at that folder only. Keep originals in quarantine. Review every page before anything is written to the Vault.

If I redact the file first, is the Claude chat privileged?
Redaction removes identifiers from what the model sees. It does not create an attorney-client relationship with Claude, and it does not make a consumer chat confidential under that ruling.
Should lawyers use Claude on matter files at all?
That is a professional-conduct question for the lawyer and the firm, not for this site. If a file is going to be read by Claude Desktop, it should not still contain client identifiers.
